Content Submission Policy

Your use of Babyganics’ products, software, services and web sites (referred to collectively as the “Services” in this document) is subject to the terms of a legal agreement between you and Babyganics. “Babyganics” means KAS Direct LLC. dba Babyganics, whose principal place of business is at 4 Kuhl Avenue Hicksville, NY 11801, United States. This document explains how the agreement is made up, and sets out some of the terms of that agreement.

I understand that all content (photos, video, messages or any other submitted materials) that I submit (including through submission of a URL link to a video on a separate website) to the Babyganics shall be subject to and shall comply with the following:

1. The content I am submitting is Appropriate Content in accordance with the following standards. Appropriate Content is content that:
   • Does not violate any other person's copyrights, privacy rights, trademarks, trade secrets, or rights in other confidential information.
   • Is not libelous, defamatory, obscene or profane.
   • Is not intended to threaten the safety of others and does not have the effect of causing a reasonable person to perceive a threat to his or her safety.
   • Contains no "viruses," "worms," "Trojan horse" or any other contaminating or destructive features, or features designed to interfere with or disrupt the normal flow or use of this website.
2. I am at least 18 years old.
3. Either I am the only person depicted in the photo or video or I have the permission of all other persons depicted in the photo or video to submit the photo or video to this website. No one else has any rights in the photo, video or other content submitted or, if someone else has rights in this photo, video or other content (for example, a friend who took the photo or video or wrote the content), she or he has given me permission to submit the photo, video and/or content in accordance with this Content Submission Policy.
4. I agree that by submitting this content, I am granting the Babyganics an unconditional, irrevocable, royalty-free license to use any content that I submit in any way that is useful to the Babyganics. This includes the right to assign, edit, modify, or dispose of the photo, video, messages or other content and to use it or them in promotional materials of the Babyganics and its affiliates, including on this website or any of its other websites, or in print, video, and all other forms of media.
5. The Babyganics does not have to give me credit for this content when it is used in any way by the Babyganics; however, the Babyganics shall, at its option, have the right to use my name in connection with any content that I submit.
6. Neither I nor the person who took this photo or video or wrote any messages will receive any compensation for any use or uses of this content by the Babyganics, its affiliates, or assignees.
7. The Babyganics, at its option, may choose not to use or display any submitted content and may remove any content from this website after display on this website.
8. Under no circumstances shall the Babyganics be required to return any of the content that I submit.
9. I am agreeing to receive, from time to time, product updates, special offers and other helpful information from Babyganics.
